Acknowledgement and Disclaimer

This agreement is between you or your company (you) and James Hardie Australia Pty Ltd ABN 12 084 635 558 of Level 3, 22 Pitt Street, Sydney 2000 andits related bodies corporate (James Hardie).

This agreement commences when your application is accepted by James Hardie and continues until terminated by either party.

  1. In submitting an application to have your name, or your company's name, added to James Hardie’s list of builders (Community) on the 'Find a Builder' section of the website:

    1. you warrant that you, and or your company (as applicable), carry, and will maintain while you are registered with this service, all of the applicable licences, qualifications and insurances required by the relevant State based and or Federallaws to conduct building work in the States in which you have represented to James Hardie that you and or your company is able to conduct business;
    2. you acknowledge and agree that James Hardie may, in its sole and absolute discretion:
      1. decline, without reason, your application to be added to Community;
      2. remove your name, or that of your company, from the Community at any time without notice; and or
      3. discontinue the Community.
  2. You acknowledge and agree that the addition of your details, or your company’s details, to the Community is on a voluntary basis and does not in any way create any form of relationship between the parties including but not limitedto, a relationship of partnership, or in which either party is an agent, legal representative, joint ventures, employee or servant of the other for any purpose whatsoever.

  3. You acknowledge and agree that the purpose of the Community is solely and exclusively to connect parties that share the common interest of building with James Hardie products.
  4. James Hardie provides absolutely no warranties or representations whatsoeverin any circumstances including to customers, in relation to any benefits that mayarise out of being listed in the Community including but not limited to lead creation or otherwise.
  5. James Hardie is not liable to you or through you to any third party, for any losses or damages whatsoever, whether direct or indirect, arising out or in relation to the listing of your details, and or that of your companies details, in the Community.
  6. If you are added to the Community, you may be given access to the contact details of potential customers. You agree and warrant that you will not access or use the contact details in any way, other than to respond to, and if engaged fulfil, enquiries and orders directed to you by the potential customer.

    You agree that you will use and disclose the contact details in accordance with James Hardies’ Privacy Policy LINK and that you have no authorisation to use the contact details for any other purposes (including for example passing them onto other builders, or adding them to your mailing list) without the express, informed consent of the potential customer. You agree and warrant that you will not make unsolicited contact with a customer whose details you may have access to.

  7. You may request that your details, and or that of your company are removed from the Community at any time, via by sending an email to the following email address: [email protected] Please allow five (5) business days for your request to be actioned.

  8. You may raise a question or concern or make a complaint at any time by contacting INSERT.
